These Terms of Service must be read in conjunction with MyHelper's Privacy Policy, Security Statement, and POPIA Compliance Statement.

1. INTRODUCTION AND ACCEPTANCE OF TERMS

These Terms of Service ("Terms") govern your access to and use of MyHelper (Pty) Ltd's platform, website, and services ("Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

MyHelper (Pty) Ltd ("MyHelper", "we", "us", or "our") reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms.

2. DESCRIPTION OF SERVICE

MyHelper provides a digital platform designed to assist South African domestic worker employers with payroll management, UIF (Unemployment Insurance Fund) compliance, COID (Compensation for Occupational Injuries and Diseases) compliance, employment contract generation, leave management, and related services. Our platform automates and simplifies compliance with South African labour legislation.

MyHelper acts as a service provider and technology platform, not as a legal advisor, labour consultant, or financial advisor. While our platform is designed to assist with compliance, it is your responsibility as the employer to ensure all legal obligations are met.

3. SUBSCRIPTION AND PAYMENT TERMS

Monthly Subscription: R249 per month for up to 15 domestic workers, with an additional R25 per extra worker per month.

Registration Fee: A once-off setup fee of R399 is payable upon initial registration.

Additional Storage: Additional storage beyond the included 1GB is available at R25 per GB per month.

Payment is due monthly and will be processed via the payment method you provide. Failure to pay may result in suspension of your account. We reserve the right to adjust pricing with 30 days' notice.

4. USER RESPONSIBILITIES

As a user of our Service, you agree to:

  • Provide accurate and complete information when registering and using our platform.
  • Maintain the confidentiality of your account credentials and notify us immediately of any unauthorized access.
  • Use the Service only for lawful purposes and in accordance with these Terms.
  • Comply with all applicable South African laws and regulations, including the Basic Conditions of Employment Act (BCEA), Unemployment Insurance Act (UIA), and Compensation for Occupational Injuries and Diseases Act (COIDA).
  • Obtain all necessary consents from your domestic workers for the collection and processing of their personal information in accordance with POPIA.
  • Promptly review and act on any compliance notifications, submission requirements, or alerts provided by our platform.

5. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, MyHelper (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our Service.

While MyHelper strives to provide accurate compliance guidance, we cannot guarantee that our platform will always reflect the most current legal requirements. Users are responsible for verifying compliance obligations independently.

6. INTELLECTUAL PROPERTY

All content, features, and functionality of the MyHelper platform, including but not limited to software, text, graphics, logos, and user interfaces, are owned by MyHelper (Pty) Ltd and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use as a domestic worker employer.

7. DATA AND PRIVACY

Your use of the Service is also governed by our Privacy Policy and POPIA Compliance Statement, which are incorporated by reference into these Terms. By using our Service, you consent to the collection, storage, and processing of personal information as described in our Privacy Policy.

8. TERMINATION

You may cancel your subscription at any time by providing written notice. Access will continue until the end of the current billing period. MyHelper reserves the right to suspend or terminate your access to the Service at any time for violation of these Terms or failure to pay outstanding fees.

9. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the jurisdiction of the South African courts.
